Legal Information
Documents Required
- Passport or another valid traveling document
- Proof of legal entry and permanence in Portugal
- Proof of health insurance
- Signed application enabling consultation of the Portuguese Criminal Records by SEF
- Non-Criminal Record Certificate from the relevant authority of the applicant’s home country or from any other country where the applicant resides for over a year
Other Requirements Under General Law
- The applicant must not have been convicted of a crime punishable with a sentence exceeding one year in prison
- The applicant must not be subject of an entry ban in Portugal
- The applicant must not be subject of alerts in the Schengen Information System
- The applicant must not be subject of alerts in SEF’s Information Integrated System issued for purposes of non-admission
Validity Periods
For the residence permit to be granted under these terms, the applicant must regularize its stay in Portugal within 90 days of the entry into the country (obtaining , in cases in which it is necessary, a short term visa – a Schengen visa – issued by the Portuguese embassy or consulate in the country of origin).
The residence permit is valid for the period of one year from the date of issue and may be renewed for successive periods of two years as long as the conditions required to be granted remain in place.
For the purpose of renewals the applicant shall demonstrate that they have remained in Portugal for at least:
- 7 consecutive or non consecutive days in the first year;
- 14 consecutive or non consecutive days in each of the subsequent periods of two years.
As means of evidence of compliance with tax obligations in Portugal, the applicant shall deliver a declaration proving the absence of debts issued by the Inland Revenue and Customs Authority and by the Social Security.
Travel Facilities
Those with an IRP (Investment Residence Permit) may travel freely around the so called Schengen Area consisting of the following 26 countries: Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxemburg, Malta, Norway, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and Switzerland.
Family Reunification
The holders of an investment residence permit may apply for family reunification under the provisions of the General Law.
Members of the family of the holders of an investment shall be:
- The Spouse;
- Children under 18 or with above 18 with incapacity and are dependents of the couple or one of the spouses;
- Minors adopted by the applicant or the spouse (if there is a Court decision which decreed the adoption ant it has been acknowledged in Portugal);
- Children above 18 (who are single, dependents of the couple or one of the spouses, and are studying at an educational institution in Portugal)
- Parents (direct first degree ascendants) of the resident or the spouse if there is an economic dependence
- Minor siblings under custody of the resident (if there is a custody decision and the acknowledgement of the decision by the Portuguese authorities)
- Partners of non-marital partnership whether the partner is inside or outside national territory (provided that the relationship is recognized under the law.
- Children under 18 or incapacitated, including children adopted by the non-marital partner provided that the partner has legal custody.
Portuguese Nationality & Passaport
The Portuguese nationality may be granted under the following conditions:
- To be at least 18 years old;
- To be a resident in Portugal for, at least six years, including those under the mentioned residence regime;
- To have a satisfactory knowledge of the Portuguese language ( a written test must be taken);
- The applicant must not have been convicted for a crime punishable with deprivation of liberty exceeding 3 years.
Once the Portuguese nationality is granted, the sons/daughters under 18 years of age may apply for the Portuguese nationality by simply declaring and proving so.
Grant of the Residence Permit
Provided all legal requirements are fulfilled, the SEF (Portuguese Immigration Office) will notify the applicant of the approval to grant the Investor Residence Permit.
